Kuwait has clarified the routes available to private-sector employees on Article 18 residency who wish to transfer to a new employer before completing three years of service.
Transfer is possible in defined situations, most commonly with the current employer's approval, and in circumstances where the employer has failed to meet its obligations.
- Article 18 covers private-sector residency in Kuwait
- Early transfer generally requires the current employer's consent
- Alternative routes exist where obligations have not been met
For companies recruiting into Kuwait, the practical effect is that candidate availability depends heavily on the outgoing employer's position. Confirm transfer eligibility in writing before making an offer.
这对雇主意味着什么
- Ask shortlisted candidates for written confirmation of transfer eligibility.
- Build transfer approval time into your start-date planning.
- Do not issue an unconditional offer before eligibility is confirmed.
